About Wrongful Death claims in Ontario

What is a Wrongful Death?

A wrongful death can occur as a result of a car accident (pedestrian, cyclist or motorcyclist), as a result of a workplace accident, a medical malpractice claim or as a result of defective products.

Who can make a Wrongful Death claim?

A parent, spouse, child, grandparent or sibling can make a wrongful death claim for the loss of a family member.

  • Injured in a slip and fall and not sure who to sue?

    Your lawyer can help you determine who the owner/occupant of the property is (who is responsible for maintaining the property) and if there are additional parties that need to be part of the lawsuit as the occupant of the property may not necessarily own the property.


    It is important to identify who the owner and occupant is. For example, an occupant could be a tenant who is renting from a home owner or condo owner, or a business owner renting a unit in a commercial building or strip mall.


    There are different types of searches your lawyer can do to determine the property owner, the business name and the business owner (i.e. if it’s a corporation).

  • How long do I have to sue after a slip and fall?

    If you intend to commence a legal action, you need to provide written notice as soon as possible. Depending on who the property owner is, you may have as little as 7 days from the day you fell to provide notification to the responsible party (or parties).


    You have 2 years from the date of the incident to commence a lawsuit.


    ​It is important to seek legal advice as soon as possible so you can determine the correct parties to put on notice and sue.
