  • What is a Personal Injury?

    A personal injury is any injury that has happened to a person as a result of an accident or incident. This could be a physical injury, or a mental or emotional injury as a result of an accident or incident like a car accident, slip and fall, traumatic brain injury or spinal cord injury.


    Personal injuries can be quite devastating and can result in a permeant disability, loss of earnings and costly medical treatments and procedures, as well as mental and emotional trauma as a result of the injury.

  • I’ve had an accident or incident. What should I do?

    The first thing you should do after an accident or incident is to seek medical help. This could be with your family doctor or the nearest hospital emergency department. Not all injuries are necessarily visible, and due to shook and adrenaline, they may not show up right away. So regardless of how you look and/or feel at the time of the accident or incident, you should still see a physician.


    If you have been is a car accident, you will want to notify your insurance company as soon as you can. You will also want to collect as much information as you can about the accident or incident. This includes the licence plate, name, number and insurance company of the other driver in a MVA, and the location and reason behind the slip and fall. As well, get the information of any witnesses for any accident or incident you are involved in.

  • When should I contact a lawyer?

    In Ontario, you have two years from the time of the accident or incident to file a personal injury claim. However, it’s best to contact a personal injury lawyer as soon as possible to discuss your case and to ensure that proper steps are taken. An experienced personal injury lawyer will also help you to learn about your rights, and will help make sure that all necessary documents and information are collected to start the process.

  • What damages am I entitled to?

    If you or a loved one have suffered a personal injury, you could be entitled to damages for a number of things, including loss of income, pain and suffering and cost of future care. This will vary deepening on the severity of the injuries, how much of the injury is your responsibility and many other factors. Our personal injury lawyers will be able to explain all of this to you, and to help calculate what damages you are entitled to.

  • How long will it take to settle my case?

    The legal process for every case is different, however personal accident cases usually take a while to resolve. Don’t let this discourage you from seeking a personal injury lawyer. 


    There are the common stages in personal injury cases in Ontario:


    • Starting the lawsuit: this includes filing a statement of claim with the courts. This must be done within two years from the accident or incident date.
    • Examinations for discovery: this is the process in which each sides lawyer investigates the facts of the case, which is done through the rules if civil procedure. Each side obtains evidence and is entitled to dispute the evidence and ask for additional documents to prove their case.
    • Mediation: this is a ‘meeting’ of all parties to discuss the case and their disputes. It’s done in the presence of a trained impartial third party person; a mediator. The mediator helps to reach a settlement agreement. If no settlement can be agreed to, the case will them go to trial.
    • Pre-Trail Conference: this generally happens within one year of the mediation. It’s a meeting between the judge, the parties and the lawyers, and is required under the Criminal Code and the Court's Criminal Proceedings Rules. The process to be followed at trial will be discussed.
    • Trial: it can take 3-5 years to get to this point. At any point before the trail, a settlement can still be reached.
  • Who will pay for my medical treatment?

    In most circumstances, the insurance company should cover the cost of any medical treatment, rehabilitation and prescriptions that are not covered under OHIP. There is usually a guideline that insurance companies follow to come up with the maximum amount they will pay based on your injuries. 


    Sometimes, however, the insurance company does not pay for these extra expenses. In this case, we will do everything that we can be ensure that your necessary medical treatments don’t stop due to insufficient funds. As well, these added costs will be taken into account at the mediation and/or trial.

  • What happens if I was partly at-fault?

    Being partly at fault doesn’t mean that you aren’t still entitled to some sort of compensation, especially if you have suffered severe injuries. If it was a car accident that you sustained injuries from, Ontario has ‘no-fault’ insurance, meaning it was no ones fault, and you can still collect benefits regardless of who actually caused the accident.

  • Can social media effect my case?

    The short answer is yes. Since the early 2000s, the Canadian Courts have allowed things seen on social media to be used as evidence if they are relevant to your claim. In fact, many insurance company’s lawyers do ask to see social media accounts in personal accident claims to ensure that nothing is being done that you are stating you can’t do. For example, if you say you can’t walk as a result on an injury, but there are photos of you running a marathon after the date of the accident or incident, this will definitely be used against you.

  • How much will a personal injury lawyer cost?

    At Aaron Waxman & Associates, there are no upfront fees, as we work on contingency. This means that we only get paid when you get paid. When the matter is resolved and settlement fees have been paid, we take a percentage off the settlement for our legal fees and our disbursements. The percentage for our fees is agreed upon at the beginning of the process, when you first discuss the case with one of our personal accident lawyers.

  • What is a Housekeeping and Home Maintenance claim?

    People who suffer from serious injuries as a result of a personal injury, such as a car accident, have trouble returning to their normal activities of daily living. This can include difficulties with tasks like housekeeping (cooking, cleaning, laundry) and home maintenance (lawn care, snow removal etc.). Some people may have to pay someone to perform these duties for them while they are recovering. It is important to keep track of the hours and duties that the person assisting you performs, and to keep all receipts. This will be helpful in establishing a loss of housekeeping capacity claim.
